Article 1. Applicability
1.1 These general terms and conditions apply to all offers, orders, and agreements entered into with Diamond Jewelry.
1.2 By placing an order through our website and completing payment, the customer confirms that they have read these terms and conditions and agree to them.
1.3 Deviations from these terms are only valid if agreed upon in writing. All other provisions remain in full force.
1.4 All rights granted to Diamond Jewelry in these terms also apply to third parties and intermediaries involved in the execution of an agreement.
Article 2. Offers and Agreements
2.1 Every offer from Diamond Jewelry is non-binding and may be adjusted at any time. We reserve the right to change prices if necessary due to (legal) obligations or other circumstances.
2.2 An agreement is only concluded after an order has been confirmed by Diamond Jewelry. We reserve the right to refuse orders without giving reasons or to impose additional conditions.
Article 3. Prices and Payment
3.1 All prices on the Diamond Jewelry website are listed in euros, including VAT, unless otherwise stated. Shipping costs are displayed separately during checkout.
3.2 Payments must be made in full without deduction via the available payment options such as iDEAL or Shopify Payments.
3.3 If a price change occurs between the time of ordering and delivery, the customer has the right to cancel the order free of charge within five (5) days after notification.
3.4 Customers are responsible for providing accurate payment information. Any errors must be reported immediately.
Article 4. Delivery
4.1 We strive to ship orders within five (5) business days, provided the product is in stock. If not, the customer will be informed and can choose to cancel or accept a revised delivery time.
4.2 Delivery takes place at the address provided with the order. Diamond Jewelry is not liable for delays due to incorrect address information.
Article 5. Retention of Title
5.1 Delivered products remain the property of Diamond Jewelry until all related payment obligations have been fully met.
5.2 The risk of loss or damage transfers to the customer from the moment of shipment.
Article 6. Intellectual Property
6.1 It is not permitted to copy or use content such as product descriptions, images, or texts without written permission from Diamond Jewelry.
6.2 The customer unconditionally respects all intellectual property rights of products delivered by Diamond Jewelry.
6.3 We cannot guarantee that our products do not infringe on the intellectual property rights of third parties.
Article 7. Returns and Right of Withdrawal
7.1 Customers should check upon receipt whether the product meets expectations. Any defects must be reported within fourteen (14) days via email.
7.2 If the product is defective or incorrectly delivered, we will, if possible, replace it or refund the purchase price after receiving the returned item.
7.3 Consumers may return orders within fourteen (14) days of receipt without giving a reason. Cancellation must be done via diamondjewelry010@outlook.com. Return shipping costs are the customer’s responsibility.
7.4 Returns are only accepted if the product is unworn, undamaged, complete, and returned in its original packaging.
7.5 Sale items cannot be returned unless they were delivered defective. In such cases, contact us within 14 days.
Article 8. Warranty
8.1 Diamond Jewelry guarantees that the delivered items meet the applicable quality standards and are free from defects.
8.2 The warranty period is six (6) months from the delivery date.
8.3 If the product does not comply with the warranty, Diamond Jewelry will choose to repair or replace it.
8.4 The warranty expires if damage occurs due to misuse or unauthorized modifications.
8.5 Legal warranty provisions remain fully in force.
Article 9. Communication
9.1 Diamond Jewelry is not responsible for miscommunication, delays, or data loss due to digital communication, unless there is intent or gross negligence.
9.2 Colors on the screen may differ from the actual product. We strive to display product colors as realistically as possible.
Article 10. Force Majeure
10.1 In case of force majeure, Diamond Jewelry reserves the right to dissolve the agreement or suspend delivery without being liable for damages.
10.2 Force majeure includes any circumstance beyond our control that prevents fulfillment of the agreement.
Article 11. Address Details and Changes
11.1 Orders are shipped to the address provided with the order. Changes must be submitted in writing.
11.2 Deviations from these terms allowed by Diamond Jewelry do not affect our rights.
11.3 If a provision is invalid under the law, it will be replaced by a valid provision with as much of the same intent as possible.
11.4 Diamond Jewelry reserves the right to use third parties in the execution of services.
Article 12. Applicable Law and Disputes
12.1 These terms and all agreements with Diamond Jewelry are governed exclusively by Dutch law.
12.2 Any disputes will be submitted exclusively to the competent court in the Netherlands.
